ARTICLE I. NAME
The name of this organization shall be the Arlington Commission on Disability as established by Town Meeting, appointed by the Town Manager, and approved by the Board of Selectmen.
ARTICLE II. PURPOSE
The purpose of this organization is to:
Act as a centralizing force in the Town of Arlington by providing information, referral, guidance, coordination, and technical assistance to public and private agencies, individuals, organizations and institutions engaged in activities and programs intended to eliminate discrimination against persons with disabilities.
Assist the Town and its citizens in bringing about full integration and participation of people with disabilities in the Town of Arlington through the following activities:
l research local problems of people with disabilities;
l advise and assist town officials and employees in ensuring compliance with state and federal laws and regulations affecting people with disabilities;
l coordinate or carry out programs designed to meet the problems of people with disabilities in coordination with the Massachusetts Office on Disability;
l review and make recommendations about policies, procedures, services, activities, and facilities of departments, boards and agencies of Arlington as they affect people with disabilities;
l provide information, referrals, guidance and technical assistance to individuals, public agencies, business and organizations in all matters pertaining to disabilities;
l coordinate activities of other local groups organized for similar purposes.
ARTICLE III. MEMBERSHIP
The Commission shall consist of nine members, all of whom shall be appointed by the Town Manager, subject to the approval of the Board of Selectman.
Section I. -- Composition
The nine member Commission shall be composed as follows:
A majority of commission members shall consist of people with disabilities;
One (1) member shall be a member of the immediate family of a person with a disability;
One member of the commission shall be either an elected or appointed official of Arlington;
The remaining members shall be parents, friends, providers of services to persons with disabilities, or other interested residents of Arlington.
Section II. -- Terms of Appointment
Each Commission members shall be appointed to a three-year term excepting that appointments of the first members shall be for one, two or three years, and so arranged that the term of one-third of the members expires each year.
Any Commission member may terminate his/her membership at any time.
Section III. -- Recruitment
The Commission members shall actively recruit, review, and recommend prospective members of the Commission to the Town Manager.
One month prior to making appointments to the Commission, the Town Manager may solicit nominations from as many organizations and individuals who represent persons with disabilities as possible to insure that appointees represent a broad cross-section of interests and disabilities.
Section IV. -- Vacancies
If any member misses three unexcused consecutive meetings of the Commission during the year, the Commission may request the resignation of that member and petition the Town Manager to declare a vacancy and proceed to fill that vacancy as as possible. No vacancy may be declared unless and until the individual is given a public hearing if requested.
The newly appointed member shall serve until the end of that vacant term, at which time the Town Manager may appoint the member for a full term.
ARTICLE IV. MEETINGS
Section I. -- Meetings
The Commission will hold at least 10 regular meetings during the year, to be at a regular time during the month at a location within the Town of Arlington which is accessible to persons with disabilities. Notice of the regular meeting, will be mailed to each member at his or her hom address or place of business one week prior to the meeting. In compliance with the Open Meeting Law, notice of meetings will be announced in the local media and posted on the bulletin board outside the Town Clerk’s Office. At the regular meeting in October, the business of the Commission shall include seating of new members, election of officers, and annual reports.
Section II. -- Special Meetings
Special meetings of the Commission may be called by the Chairperson or any two members of the Commission, upon notice to all of the members of the Commission.
Section II. -- Quorum
A quorum for the conduct of official business shall consist of a majority of the appointed members.
Passage of a motion requires a majority vote of members present.
ARTICLE V. OFFICERS
Section I.-- Election
Officers of the Commission shall consist of a Chairperson,Vice Chairperson, Secretary, to be elected for a term of one year. An individual may serve no more that two (2) consecutive terms in office.
Section II.-- Duties
Chairperson--The duties of the Chairperson shall be to set the agenda for meetings, and to represent the Commission, to preside at the meetings, and to represent the Commission in an official capacity when necessary.
Vice Chairperson--In the absence of the Chairperson, the Vice Chair presides at the meetings and represents the Commission.
Secretary—The duties of the Secretary shall be to assure that meeting notices and agendas are distributed to members, to report to the Commission when a member has missed more than three (3) unexcused absences during the year, to notify the Town Manager when Commission vacancies occur, and to officially record the minutes at regular and special meetings of the Commission.
ARTICLE VI. AMENDMENTS
These bylaws may be amended at any time by a two-thirds majority of the members, but amendments must be in conformance with the Commission’s establishing article and Section 8J of Chapter 46 of The Massachusetts General Laws.
